Terms of Use

Introduction

Please read these terms of use ("Terms") carefully. They constitute legally binding contractual content between you and Pin the Tale, located at pinthetale.co.uk.

Scope

These Terms apply to you if you sign up to create a user account on our website Pin the Tale ( pinthetale.co.uk) or use any accompanying services. Pin the Tale is provided by the website's creator, Jack Lowe.

Use of Pin the Tale

By using Pin the Tale, you acknowledge that you have read and understood these Terms and that you agree to be bound by them. You also represent and warrant that you are at least 18 years of age. If you are younger than 18, or otherwise do not have the authority to enter into agreements such as these Terms, you represent that your legal guardian, or a holder of parental responsibility, has reviewed and agreed to these Terms on your behalf. If you do not wish to be bound by these Terms, you may not access or use Pin the Tale.

Description of Pin the Tale

Pin the Tale is a platform for connecting with the world around you through stories. It takes place on a UK-wide digital story map that is freely accessible via any web browser on smartphone, tablet or PC/Mac.

The map uses the what3words grid, a system that divides the world into 3m x 3m squares and gives each one a unique three-word address.

Users of Pin the Tale can use the platform to:

• Create stories about places in the UK by uploading text that includes all three words of the places' what3words addresses, as well as an image of the place showing details that can be found at that location in the present day. Story texts can take any creative form (e.g. fiction, non-fiction, poetic, imaginative, historic), as long as they connect in some way to the places indicated by the stories' associated what3words addresses.
• View stories created by other users and identify the locations (what3words addresses) associated with these stories. Correctly identifying the locations of other users' stories will add them to the list of 'Solved Stories' associated with a user's account.
• Compete with other Pin the Tale users via our leaderboards, which rank users based on how many stories they have solved and created on Pin the Tale.

User account

In order to use Pin the Tale, you must first register a user account through the website. To register, you must enter your email address and a password of your choice. Your user account is personal, and you are not entitled to give access to or transfer your account to anyone else. You are responsible for keeping your login details confidential and not disclosing or otherwise sharing your login details with anyone else. If you suspect that someone else has access to your account, please contact us immediately at hello@pinthetale.co.uk.

Your provision of content

Username

Pin the Tale enables users to set a username. By setting a username, you are aware that this name will be visible to other users and may be shared with others, including other people who are not users of the website. You are also aware that this username will be associated with your account's submitted, solved and bookmarked stories, and this association will be visible to other users and to Pin the Tale.

Stories

Pin the Tale includes functions for creating 'stories', which involve uploading user-generated content in the form of text and images to the website and attaching these to a location on the Pin the Tale map. By creating stories, you are aware that this user-generated content, its attached location and its association to any username that you set will be visible to other users and may be shared with others, including other people who are not users of the website.

Warranty

You are only allowed to upload content that you own or that you are entitled to manage and upload to the website. You are not allowed to upload content that includes illegal, violent, offensive, pornographic, or otherwise improper content. By uploading content to the website you warrant that the text and images, and your use of the text and images, in no way violates any applicable legislation or any third party's rights. Pin the Tale does not assume any responsibility or liability for content uploaded by you as a user, for removing it, or not removing it or other content.

Reserved rights

We reserve the right, at any time and at our discretion, to remove any content that violate these Terms or that we consider to be inappropriate or unsuitable.

Permitted use and prohibited behaviour

Pin the Tale may only be used for the intended purposes. You undertake not to:

• give access to your user account to anyone else;
• copy or distribute the website in any way other than as required for using Pin the Tale;
• use Pin the Tale with an incompatible or unauthorised device;
• reproduce or access Pin the Tale to design or create a competing product or service, a product that uses similar ideas, features, functions or graphics as Pin the Tale, or copy any ideas, features, functions or graphics from Pin the Tale;
• use automatic programs or scripts, including but not limited to web spiders, crawlers, robots, ants, indexers, bots, viruses or worms or other programs that may make multiple server requests per second, or that unnecessarily burden or hinder the operation and/or performance of Pin the Tale;
• disrupt or obstruct Pin the Tale's capacity or performance or data contained in it or attempt to gain unauthorised access to Pin the Tale or its related systems or networks;
• use your account or Pin the Tale for illegal purposes;
• attempt to do damage to Pin the Tale and its associated services in any way.

In case we detect behaviour that we consider to be inappropriate or illegal, we have the right to investigate how you use your account and behave when using Pin the Tale. In such cases, we have the right to either put a temporary suspension or permanent ban on your account.

Inappropriate user content includes but is not limited to text, images and other media that can be considered offensive, discriminatory, abusive, threatening or pornographic, or that are portraying trademarked or copyrighted materials, advertising, marketing or promotional material.

Inappropriate activities include advocating violence, using Pin the Tale for illegal activities, uploading abnormal quantities of repetitive content and/or content we deem inappropriate (spamming), and exposing users' personal information, including email addresses and passwords.

We have the right to investigate and may involve and cooperate with authorities in order to prosecute offences committed through use of Pin the Tale. We reserve the right, at any time and without notice, to remove or disable access to your user account if you violate these Terms, or otherwise use Pin the Tale in a way that we believe conflicts with these Terms or is otherwise damaging to Pin the Tale and its associated services.

Our systems have only certain capacity. If our system limits are met due to large amounts of activity from your account, such as numerous reloads of our website, your account may be suspended in order for Pin the Tale to stay operational.

Third party services

Pin the Tale may include links to products, services, features and/or functionality operated by other third parties. Third party services which are made available through Pin the Tale are made and offered directly by the applicable third party. When you pursue any such service, you acknowledge that you are contracting directly with such third party and not with us.

Your interactions with third parties found on or through Pin the Tale are solely between you and such third parties and are subject to such third parties' terms and conditions. You are advised to read any third party service's terms, including terms of use/service and privacy policy, carefully as they constitute an agreement between you and the third party.

You acknowledge and agree that we are not responsible or liable for the third party service's terms, products, content, or actions, including their failure to comply with their terms of use/service or privacy policy. Third parties act beyond our reasonable control and we shall not be held liable for any damages caused by an action or omission attributable to them. You hereby agree that we shall not be liable for any loss or damages of any kind incurred by you as the result of any of your dealings with third party service providers or advertisers available through Pin the Tale.

Privacy

Intellectual property rights

Our rights

All contents of Pin the Tale, including but not limited to logos, icons, trademarks, graphics, text, images, moving images, designs, sound, illustration, software, domains etc. (the "Intellectual Property Rights") are owned by us or our licensors.

Your license

Upon acceptance of these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use Pin the Tale on the website.

Restrictions

All use of Intellectual Property Rights which is not expressly permitted in these Terms, by applicable law or authorised by us, is prohibited.

Rights you grant

You retain ownership rights over any content (e.g. stories) that you submit to Pin the Tale ('user-generated content'). However, we do require you to grant certain rights to Pin the Tale, as described below:

License to Pin the Tale: Upon creation of any stories or other user-generated content through Pin the Tale, and in the event that such user-generated content gives rise to any intellectual or industrial property right (such as copyright), you thereby grant Pin the Tale a free-of charge, perpetual, royalty free, worldwide, non-exclusive license to access, process, reproduce, display, distribute, prepare derivative works, commercialise, copy and store this user-generated content.

Commercial use

Videos and streaming

By streaming videos about Pin the Tale on other websites and services, such as on Twitch and YouTube, we understand that sometimes this entails receiving monetary compensation for advertisement placed in the videos. We do not restrict such commercial use and allow the use of our names, logos, icons, trademarks, graphics, images, moving images, sound, and illustrations, as applicable (altogether "Assets") for such purposes, subject to the terms described in these Terms of Use.

Restrictions to commercial use

Your videos shall be available to consumers free of charge at the time of consumption, and your revenue shall derive from other sources, such as through sponsors or advertisement banners in your videos. You may not use our Assets to distribute your videos through channels that are provided pay-per-view or require a paid subscription, unless such videos are also made available to consumers free of charge.

Conditions for streaming

You may use our Assets for videos uploaded to other sites (such as Twitch and YouTube) for the above-described purposes, when the following conditions are met:

• your video is accessible to consumers free of charge,
• the Pin the Tale name and trademark occurs in a subsidiary name or title or is a subsidiary part of the name or title of the video,
• it is necessary to use our Assets for the purpose of the video,
• you add your own unique content to the videos, such as your voice and/or pictures,
• you don't sell physical copies of such videos,
• you don't distribute your videos on television, and
• you don't include illegal, violent, offensive, pornographic, or otherwise improper content in your videos.

Unless specifically agreed between us, you may not use our Assets in a way that indicates that we would be the publisher, have approved or any way be associated with the uploaded videos.

Intellectual property

In relation to all use of our Assets (whether permitted or not), all Intellectual Property Rights are and shall remain vested in Pin the Tale. We have the right, at any time and at our discretion, to revoke your right to use our Assets if we consider it to be inappropriate or unsuitable.

Requests

All commercial use that is not described herein shall be prohibited. For any other use or of our Assets than described in these Terms of Use, you must be granted prior written approval. You can contact us at hello@pinthetale.co.uk.

Your obligation to indemnify

You undertake to indemnify and hold us harmless for all costs, damages and losses incurred by us because of or in connection with your violation of these Terms.

Our liability

Availability

Our intention is to keep Pin the Tale running 24 hours a day and to ensure the content is up to date. We do not, however, guarantee that Pin the Tale is free from errors, deficiencies, malicious software, or viruses, or that the content is correct, up to date or complete, or that Pin the Tale is always in operation.

Limitation of liability

We use reasonable efforts to ensure that errors and mistakes do not occur in our content. However, you accept that your sole right of recourse in case of an error in Pin the Tale is that you may at any time stop using Pin the Tale and terminate your agreement with us, i.e. delete your account. We shall not be liable for damages arising from use of Pin the Tale, including damage caused by malware, viruses or other incorrect or incomplete information, unless such damage arises because of intent or gross negligence on our part. We are at no time liable for indirect damage or loss that affects users, which without limitation includes loss of profit or revenue, loss of goodwill or loss of expected savings.

Applicable law and dispute resolution

These Terms shall be interpreted and applied in accordance with the law of the United Kingdom of Great Britain and Northern Ireland. Disputes arising from dealings between Pin the Tale and a user of Pin the Tale shall be examined in a court of law, unless otherwise specified by mandatory legislation.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Changes to the Terms

We may modify these Terms at any time. In the event of changes which are not minor and may affect you, you will be notified via email. We will then inform you that it is important to object if you do not approve of the changes. If we do not get such objection within thirty days after the changes were communicated, we will assume that you approve of the changes. We will also assume that you accept the changes where you continue to use Pin the Tale after the new conditions have been submitted. What constitutes a 'not minor' change will be determined at our sole discretion. The latest version of the Terms will be available on the website.
